1. Agreement to Terms
By accessing or using Brocally (“the Platform”) at feelthekorea.com, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Platform. Brocally is operated by Feel Korea and is based in Seoul, South Korea.
2. The Platform
Brocally is a marketplace that connects travelers with local Korean hosts who offer tours, cultural experiences, and travel services. Brocally facilitates the connection and handles payment processing, but is not the direct provider of the tour or service itself. The local host or service provider is solely responsible for delivering the experience as described.
3. User Accounts
- You must be 18 years or older to create an account and make bookings.
- You are responsible for maintaining the security of your account credentials.
- You must provide accurate information when creating your account and making bookings.
- One person may not create multiple accounts. Duplicate accounts may be suspended.
- You are responsible for all activity that occurs under your account.
4. Bookings and Payments
- Bookings are confirmed once payment is successfully processed through PayPal or Polar. You will receive a confirmation email.
- All prices are listed in US Dollars (USD). Currency conversion is handled by your payment provider at their current rates.
- Brocally charges a service fee included in the displayed price. This fee covers platform operations, customer support, and payment processing.
- Payment information is processed by PayPal or Polar. Brocally does not store your full payment card details.
5. Cancellations and Refunds
Cancellation and refund policies vary by tour or service. The applicable policy is displayed on each listing page before you complete your booking. In general:
- Cancellations made more than 48 hours before the scheduled experience are eligible for a full refund minus payment processing fees.
- Cancellations within 48 hours of the experience may be subject to a partial or no refund, depending on the individual listing policy.
- If a local host cancels or fails to appear for a confirmed booking, you are entitled to a full refund. Contact us at feelkservice@gmail.com immediately.
- Refund requests must be submitted within 7 days of the scheduled experience date.
6. Local Host Responsibilities
Local hosts listed on Brocally agree to:
- Provide accurate and truthful information in their profile and listings.
- Deliver experiences as described, on the scheduled date and time.
- Communicate promptly with travelers who have confirmed bookings.
- Comply with all applicable Korean laws regarding commercial tourism activities.
- Not engage in discriminatory behavior based on nationality, race, gender, religion, or disability.
Brocally reserves the right to remove any host from the platform for violations of these standards.
7. Traveler Responsibilities
As a traveler using Brocally, you agree to:
- Treat local hosts respectfully and professionally.
- Arrive on time for confirmed bookings. Repeated no-shows may result in account suspension.
- Not engage in harassment, discrimination, or illegal activity during an experience.
- Submit honest and accurate reviews based on your actual experience.
- Not attempt to circumvent the Platform by arranging payments directly with hosts outside Brocally.
8. Reviews and Content
By submitting a review or other content to Brocally, you grant us a non-exclusive, royalty-free license to display that content on the Platform. You are responsible for ensuring your content is accurate and does not violate any third-party rights. We reserve the right to remove content that is false, offensive, or violates these Terms.
9. Limitation of Liability
Brocally is a marketplace platform and is not responsible for the actions or omissions of local hosts or travelers. To the maximum extent permitted by law, Brocally's total liability for any claim arising from use of the Platform is limited to the amount you paid for the specific booking giving rise to the claim. We do not guarantee the accuracy of host listings or the quality of experiences.
10. Intellectual Property
All content on the Brocally Platform — including text, photographs, logos, and design — is the property of Feel Korea or its content contributors and is protected by copyright. You may not reproduce, distribute, or create derivative works from Platform content without our written permission.
11. Governing Law
These Terms are governed by the laws of the Republic of Korea. Any disputes arising from these Terms or use of the Platform shall be subject to the jurisdiction of the courts of Seoul, South Korea.
12. Changes to Terms
We reserve the right to update these Terms at any time. We will post the revised Terms on this page with an updated “Last updated” date. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.
